After a year later, the issue concerning Dr. Glen Dolberg, a Delta instructor accused of sexually harassing Steven Swofford, his former student, has not been resolved.
The complaint was filed in Nov. of 2003, and then a panel of three Delta employees completed an investigation in July of 2004.
The only action that has gone on was a hearing, which was held in July of 2004, that Swofford's attorney Davey Turner acknowledged, but nothing more since than.
"He (Dolberg) might have appealed, but I'm not aware of it," said Turner.
Delta President Raul Rodriguez noted the steps of the process that has kept the issue going.
An investigation is conducted, than the defendant has a chance to review the conclusion and have a second hearing. Phase two is punishment, which than can be responded to again.
"We want to follow the letter of the law," said Rodriguez. Currently, the process is stuck on hold, waiting for an independent arbitrator, since Dolberg didn't want Rodriguez to do it.
"I tried not to get involved. I'm supposed to do the hearing, but Dr. Dolberg didn't want me to do so," said Rodriguez.
Turner said that no lawsuit against the school for failing to discipline the instructor has been filed. He is still involved with the Swofford family, but no new action has taken place since the hearing in July of 2004.
